LOCAL LAW #6-2010

of the Town of Putnam Valley duly adopted Local Law #6-2010 on August
11, 2010. A Local Law electing a Retirement Incentive Program as
authorized by Part A of Chapter 105, Laws of 2010 for the eligible
employees of the Town of Putnam Valley.

HILLTOP ESTATES BEACH PROPERTY BOAT REGISTRATION LAW
LOCAL LAW #5-2010
PLEASE TAKE NOTICE, that the Town Board
of the Town of Putnam Valley duly adopted Local Law #5-2010 on July 21,
2010. A Local Law to amend Chapter 100 (Special Districts) of the Town
Code of the Town of Putnam Valley so as to require the registration of
boats stored on and/or operated from the Hilltop Estates Beach Property.

HOW TO COMPLY WITH THE
“SEPTIC PUMPOUT LAW” (Local Law #2-2010)
Lake Oscawana
has been declared an “303-d Impaired Water body” by the New York
State Department of Environmental Conservation.
Lake Oscawana is
impaired by an overloading of phosphate. As one part of a
comprehensive plan to reduce the level of phosphate on Lake
Oscawana, the Town of Putnam Valley has passed a “Septic Pump
Out Law.”
Background

The Federal Clean Water Act requires states to
periodically assess and report on the quality of waters in their
state. Section 303(d) of the Act also requires states to
identify Impaired Waters. For more information, please

What Are Phosphates? Phosphates come
from many different sources. They come from human, animal, and
industrial wastes. It can also come from human disturbance of
the land. Phosphates also run into lakes and water bodies as a
result of improperly functioning septic systems. The phosphates
in runoff also cause changes in the aquatic life of the
waterways they run into. It kills off fresh water life and is
replaced with fewer numbers of species that can tolerate low
levels of dissolved oxygen. Ultimately, it can turn areas of a
lake (or an entire lake) into an algae filled, swamp like area.
THIS IS NOT THE SITUATION IN LAKE OSCAWANA, BUT WE NEED TO TAKE
ACTION TO PREVENT THIS FROM HAPPENING.
Accordingly,
Putnam Valley has passed a “Septic Pumpout Law.” This law is
posted on the town website.
In pertinent
part, the law states as follows:
“The owner of each lot with the watershed of a 303-d impaired
waterbody, and which contains one or more septic systems, shall
cause said system(s) to be pumped, cleaned and inspected by a
licensed septic contractor (in a manner sufficient to enable
the inspector to furnish the information required in Section
8…hereof) with the time periods specified in Paragraph “4”
hereof, and al least once every three (3) years…”
If your home or property is a waterfront home (all or part of
the lot is contiguous to the waterbody) your septic system must
be pumped out within twelve (12) months.
If your home or property is on a non-waterfront lot but is
wholly or partly within 200 feet from the waterfront, your
septic system must be pumped out within twenty four (24) months.
All other homes/property - your system must be pumped out
within thirty six (36) months.
HOW TO
COMPLY:
Section (8)
of the law reads as follows:
(8) Upon completion of a septic system Pumpout and
inspection, each lot owner shall, within 30 days following such
pumpout, provide the Town Code Enforcement Officer (“CEO”
hereafter) with a paid receipt from the septic contractor, which
receipt shall state:
a. The lot owner’s name; and
b. The street address and tax map designation of
the lot; and
c. The pumpout date; and
d. The contractor/inspector’s report of any
observed functional irregularities and/or
deficiencies in the system, and his/her recommendations,
if any, for additional maintenance and/or remediation.

PROHIBITION OF GRAFFITI UPON ANY PUBLIC/PRIVATE PROPERTY
LOCAL LAW #3-2010
PLEASE TAKE NOTICE, that
the Town Board of the Town of Putnam Valley duly adopted Local Law #3-2010
on February
17, 2010 entitled “A Local Law to Amend Chapter 165 of the Town
Code of the Town of Putnam Valley (Zoning), So As To Prohibit the Making of
Graffiti Upon Any Public or Private Property, and To Repeal Section 167-74
of the Town Code as Redundant.

ROARING BROOK LAKE BOAT RESOLUTION
RESOLUTION # R 10-111
WHEREAS
Roaring Brook Lake Park district (the “District”) is a Special
Improvement District created by the Town Board of the Town of Putnam Valley;
and
WHEREAS
the District owns and operates several properties adjacent to
Roaring
Brook Lake
for the benefit of District residents; and
WHEREAS
District residents regularly utilize said properties for the storage
and operation of personal, non-motorized watercraft including, but not
limited to, boats; and
WHEREAS use of District-owned properties and
storage and launching of boats is limited to District residents and
WHEREAS identification of authorized boats is
established by means of registration stickers issued to District residents
and applied to their watercraft; and
WHEREAS numerous boats have accumulated on
District-owned property which lack current (green) registration stickers and
which are haphazardly stored in ways which risk injury to children and
others using District-owned property; and
WHEREAS the Town Board wishes to identify all
watercraft belonging to District residents by insuring proper registration
thereof and to remove all watercraft not so registered.
NOW, THEREFORE,
be it
RESOLVED, that all
owners of
watercraft stored and/or maintained on District- owned
properties shall obtain and
affix to
the watercraft in a visible manner a green registration sticker, same
to be obtained at no fee from the Putnam Valley District Clerk; and be it
further
RESOLVED, that all watercraft located on
District-owned properties and not displaying a green registration sticker
shall be removed by their owners from District-owned properties no later
than midnight, June 13, 2010; and be it further
RESOLVED, that unregistered watercraft found on
District-owned properties after June 13, 2010 shall be deemed
abandoned and will be auctioned by the District on June 26, 2010 at 2:30 P.M. at
North Beach; and be it further
RESOLVED, that the net proceeds of such auction
shall become funds of the District, and be it further
RESOLVED, that any unregistered watercraft offered for auction and not sold at
auction shall be removed from the District-owned properties or destroyed, at
the discretion of the District, and be it further
RESOLVED, that a copy of this Resolution shall
be published in the Putnam County News and Recorder on May 5, 2010 and May 12, 2010; and
be it further
RESOLVED, that a copy of this Resolution, along
with a letter from Town Supervisor Tendy in the form attached hereto, shall
be mailed to all District taxpayers no later than April 26, 2010
and be it further
RESOLVED, that
a copy of this Resolution shall be posted on the Putnam Valley website, and
in the Putnam Valley Town Hall, within 5 days following its adoption.
